Thank you for taking part in "Data For A Cause Challenge" (the "Challenge"). By participating in the Challenge, you are agreeing to these Official Rules, so please take a few minutes to read them over. If you do not agree with these Official Rules please do not enter this Challenge.
There are three parties entering into this agreement: you, me and them.
In this agreement, the second-person pronouns "You", "Your", "Yours", etc. refer to you.
Similarly, the first-person pronouns "I", "Me", "My", etc. refer to Olga Tsubiks, the organizer of this challenge and owner of the website olgatsubiks.com.
The third-person plural pronouns "They", "Them", "Their", etc. refer to the mission-driven organizations, the beneficiaries of this Challenge.
Phrases such as "us", "all of us", "all parties" refer to all of us collectively.
The term "Challenge Page" refers to olgatsubiks.com/data-for-a-cause.
The term "Submission" or "Entry" refers to information you submit to the Challenge including data visualizations via the Challenge Website or social media.
The term "Volunteer" refers to single individuals who submit an Entry to the Challenge on behalf of themselves or a team.
The term "Organization" refers to any organization that participates in the Challenge. Organizations select the winners of the challenge. The opinions of the Organizations are their own and I am not responsible for anything that Organizations post on their websites or other communication channels.
The term "Data" refers to the data provided by the Organizations or otherwise obtained from open source data sources.
Purpose and Description
The challenge is open to data professionals, analysts, designers and anybody skilled in producing data visualizations or infographics. Volunteers must be 18 years of age or older at the time their Entry is submitted. The challenge is open to individuals and teams, however, only a single individual may be a Volunteer. Teams must designate a Volunteer on their behalf. This Challenge is void wherever prohibited by law.
How to Enter
No purchase is necessary to enter or win. Instructions for entering the Challenge are set forth at the Challenge Page.
All entries must be written in English. Entries to the challenge will not be accepted after the announced Challenge Submission Deadline. I reserve the rights to change any Submission Deadline at any time in my sole discretion for any reason or for no reason. Entries that do not comply with the Official Rules for the Challenge will be disqualified. Whether a Volunteer's Submissions is a winner or not will be determined solely by Organization or its designee. The decision of organization or its designee's will be final and binding. Limit one (1) entry per Volunteer.
You represent and warrant that you will use the Challenge Page in good faith, will use your real name and only provide accurate information to the Challenge, that your submission is original, truthful, owned by you, has not been previously published elsewhere, and was created solely for the purpose of entering the Challenge. You further acknowledge and stipulate that:
You are an individual submitting your own original idea.
You are solely responsible for accessing and downloading the Data. I am not, and nor is the Organization, responsible in any way if you are unable to obtain the Data or if you experience difficulties or delays in obtaining the Data, for any reason whatsoever.
You are responsible for understanding your employer’s policies regarding your eligibility to participate in this Challenge. If you are participating in violation of your employer’s policies, you may be disqualified.
You will not violate any rights of the Organization or any third party, including, but not limited to, intellectual property rights such as copyright or trademark rights or trade secret rights.
You are responsible for providing at your cost all equipment, software, mobile access, and Internet access necessary for you to participate in the Challenge.
You will not post or submit any material that is inappropriate, offensive, profane, pornographic, racist, bigoted, harassing or intended to cause insult or suffering in others.
You will not post or submit content that violates third party rights (such as copyright or other intellectual property or personal rights) or applicable laws.
You will not copy or transfer any part of the Challenge Page.
If your actions cause any losses to me or the Organization, either directly or indirectly, you agree to pay all damages, losses and costs incurred as a result. This includes any claims brought against me or the Organization by third parties as a result of your actions.
You will not copy, broadcast, display, sell or transmit any of the copyrighted information on the Challenge Page.
You will not “hack” or reverse engineer any of the software, applications or services running on the Challenge Page.
You will not use the Challenge Page in the commission of any crime.
You will not advertise, tell directly or imply indirectly to anyone that you are affiliated with or endorsed by the Organization. You also will not use any of logos or trademarks without a written permission.
You will not attempt to override any access controls or security measures on the Challenge Page.
You agree that I may contact you about this Challenge via the email address supplied with your Entry.
You will not interfere with or disrupt access to the Challenge Page.
License and Warranty for Your Submission
You retain ownership of the information you submit to the Challenge. However, you grant the Organization a license to use your Submission and the information you provide, as follows:
They may share this information with their affiliates.
They may display, reproduce, distribute, perform publicly, create derivatives from, and publicize this information freely in any manner or media, including but not limited to the Internet and print media.
This license applies worldwide, in perpetuity and is irrevocable.
You grant this license to them completely free of charge and without royalty now or in the future.
Once you submit an Entry to the Challenge, the information you provide, such as, your name, team name, contents and the title of your Submission will become public for anyone on the Internet to view. After the Challenge Submission Deadline, the content of your Submission can be displayed at the Challenge Page.
If you want me to delete your information after it has been posted, I will consider your request but I am under no obligation to grant your request.
You represent and warrant that you are entitled to submit the information and that the information is accurate, not confidential, and not in violation of any contractual restrictions or other third party rights.
I may, at my sole discretion, for any reason or for no reason, and at any time, remove your information, including but not limited to your user photo, Submission, and comments, from the Challenge Page. You acknowledge that you have no rights to seek any damages or any other compensation in the event that I delete your information.
You understand and agree that you will receive no compensation for your Submission or for any other work in relation to this agreement.
Limitation of Liability
You agree to release me and Organizations completely and in perpetuity from any liability to you for any damages, costs or expense direct or indirect, whether by our negligence, action or omission of action, that you may incur related to these Official Rules, your participation in the Challenge or your use of the Challenge Page.
Organizations will review all eligible entries received and announce winners. They have the sole and final authority to accept or reject Submissions. They reserve the right to reject any Submission for any reason or for no reason, and you shall have no recourse, legal or otherwise, if your Submission is rejected. They reserve the right to disqualify anyone from the Challenge for any reason or for no reason. You hereby relinquish your right to dispute the decision now and in perpetuity by any means including, but not limited to, legal action and injunctive relief. You also agree that you will not seek any damages from the Challenge arising from the results of the online judging of the Entries.
Suspension or Interruption of Service
I do not guarantee that the Challenge Page will be available and accessible all the time. You agree that you have no right to any damages for any losses you incur directly or indirectly as a result of unavailability of the Challenge Page.
The Official Rules and the materials referred to herein constitute the entire agreement between the Parties and supersede all previous agreements and understandings, whether oral or written, between the Parties with respect to the subject matter hereof.
What If The Challenge Can’t Run As Planned?
If someone cheats, or a virus, bug, catastrophic event, or any unforeseen or unexpected event that cannot be reasonably anticipated or controlled (Force Majeure) affects the integrity or fairness of this Challenge, I and the Organization reserve the right to cancel, change, or suspend the Challenge, whether the event is due to human or technical error. If a solution cannot be found to restore the integrity, they reserve the right to select winners from among all eligible entries received.
I shall not be liable for delays or failure to meet its obligations pursuant to this Agreement due to causes beyond the my reasonable control.
How Can I Find Out Who Won?
I will post the names of the winners online at the Challenge Page. This list will remain posted one month after the Event.
